Frequently Asked PreTrial Questions
- Do I have to agree to participate in PreTrial supervision?
No, you do not have to agree to participate. However, the court ultimately will decide whether or not PreTrial Supervision will be made a condition of your being released on bond prior to your trial. If Pre Trial Supervision is made a condition of your bond, you would have to agree and comply with it’s terms to be placed on bond.
- What happens if I do not comply with the PreTrial conditions of release?
The PreTrial Officer will notify the court of the your non-compliance and the judge can revoke the bond and order you to be returned to jail.
- What happens if I miss an appointment?
A missed appointment is a violation of the conditions of your release. If you encounter circumstances beyond your control that may cause you to miss an appointment, call your PreTrial Officer to discuss the issue. The PreTrial Officer will make accommodations for valid circumstances. However, disregard for the conditions of your release may result in your bond being revoked.
- Will the judge know about my conduct while on PreTrial Supervision?
Yes, reports are submitted to the court when a person is scheduled for a hearing, trial, or sentencing. The judge may use the PreTrial report to help determine whether you should remain out on bond pending future court dates or what kind of sentence you should receive.
The judge will also be notified if you are not complying with the conditions of your release. PreTrial Officers may also request that your bond be revoked if you are not following the conditions of your release.
- Who do I have to notify if I move or change employers?
If you move or change employers while on PreTrial Supervision you must tell your PreTrial Officer. You should further notify the Clerk of the Court and your attorney of any change in address.
- Why do I have to be drug or alcohol tested?
The court may determine to make drug or alcohol testing a condition of your release. Should that determination be made by the court, you will be required to undergo random drug or alcohol testing. Failing to comply would be a violation of your release and may cause your bond to be revoked.
- When will my PreTrial release be completed?
Your supervision will be completed once a final disposition is made on your case and the judge tells you it is complete.
- Can I leave the state while under pretrial supervision
You must have prior approval of the court for any out of state travel.
- Tips for successful PreTrial participation
- Report for all appointments at PreTrial and/or treatment programs.
- Report any problems you are having to your PreTrial Officer.
- Keep a record of all of your treatment appointments, including the date and who you saw.
- Report any changes in your address, employment or telephone number to PreTrial and your attorney.
- Obtain an attorney as soon as possible.
- Report any problems you are having to your PreTrial Officer.
- Report to court for all of your court dates.
- Refrain from conduct that may result in your arrest.
